When a City agency engages in construction work which spans, crosses, or is adjacent to railroad rights-of-way, it may be necessary for railroad employees to be at the construction site to perform various functions (e.g., coordinating train timetables with construction schedules, taking measures to protect railroad property from accidental damage, etc.). In such cases, the City may be required to reimburse the railroad for the work performed by these railroad employees. The City will negotiate labor surcharge rates with the railroads based upon the rates set forth in the Federal Highway Administration's "Federal Aid Highway Program Manual".
