Policy AM-413-51 Grant Subrecipient Monitoring & ManagementLinkCopy Citation
purposePURPOSE
Ongoing agency/entity monitoring of subrecipient(s)’ pass-through funding combined with the subrecipient’s inherent requirement to manage funds is vital to ensuring strong financial accountability, good governance and control over a grant’s implementation and impact. Therefore, to maximize financial control of grants within the City of Baltimore this policy standardizes a series of comprehensive fiscal and quality controls in the collection, monitoring, and management of all subrecipient grant funds.
scopeSCOPE
This policy is applicable to all City of Baltimore agencies/entities that use grant funding, as well as any other organizations for which the city serves as a sponsor or contributes grant resources. Additionally, while the agency/entity’s responsibilities and subrecipient requirements are essentially the same, this policy delineates agency/entity monitoring from subrecipient management. This policy goes into effect at the date of Board of Estimates approval and supersedes any and all City of Baltimore agency subrecipient monitoring standard operating procedures or policies.
policy-statementPOLICY STATEMENT
This policy applies to all grants received by the City of Baltimore regardless of funding source. It ensures all grant funding is used in compliance with its intended purposes, with quarterly financial reconciliations to ensure ongoing fiscal control and compliance.
When working with grants, all City of Baltimore agencies/entities and their respective subrecipients must follow the primary rule of accountability: If it is not documented, it did not happen; failure to document can result in risks of non-compliance and disallowed costs. Therefore, collecting, storing, and compiling data and documentation are essential to each grant as well as the health of the city’s overall grants management program to provide evidence of:

Compliance – with the subrecipient’s Statement of Work (contract terms), all applicable federal and state laws, and all COB AM Policies;

Performance – measuring each grant’s program goals and performance targets against stated objectives;

Outcomes – documenting the benefits and/or achievements in skill, knowledge, behavior, condition, or life status of program participants; and,

Fulfillment – satisfaction of the grant’s purpose, and the identified public need met.

To this end, all City of Baltimore staff members working with grants as well as their respective
subrecipients are required to:

Understand and demonstrate the importance of fiscal integrity and ethical values when making monetary decisions;

Recognize that financial integrity and operational results take priority; and,

Realize that collaboration, inter- and intra-agency communication, and teamwork are imperative to the city’s overall success in grants management.

2 CFR §200.303 Internal Controls: States, the recipient and subrecipient must:
(a)
Establish, document, and maintain effective internal control over the Federal award that provides reasonable assurance that the recipient or subrecipient is managing the Federal award in compliance with Federal statutes, regulations, and the terms and conditions of the Federal award.
Note: Additional subrecipient requirements can be found in sections: §200.331 (Subrecipient and contractor determinations), §200.332 (Requirements for pass-through entities), and §200.333 (Fixed amount subawards).
It is important to remember OMB Uniform Guidance §200.331 Subrecipient and contractor determination stipulates the pass-through entity must use judgment in classifying each agreement as a subaward or a procurement contract. In making this determination, the substance of the relationship is more important than the form of the agreement.
Moreover, 31 USC 7502(f)(2) (Single Audit Act Amendments of 1996 (Pub. L. No. 104-156)), 2 CFR §200.332, states pass-through entities (agencies) must identify the award and applicable requirements, evaluate risk, monitor, and ensure accountability of subrecipient(s).
Award Records Transfer & Storage:
Per OMB Uniform Guidance § 200.336 Methods for collection, transmission, and storage of information, when practicable, the Federal agency or pass-through entity and the recipient or subrecipient must collect, transmit, and store Federal award information in open and machine-readable formats.
Therefore, to ensure the timely collection of grant funds and reliable transmission and storage of grant award and financial documentation, and minimize the city’s financial risk, all grant documentation to support award approvals and financial transactions (e.g., award letters, BOE approvals, supplier/subrecipient contracts, and purchase orders) must be uploaded as attachment(s) and stored within Workday. The documentation must be managed in accordance with OMB’s 2 CFR Part 200: Uniform Administrative Requirements, the City’s Administrative Manual (AM) Policies for grants management, as well as the internal controls and monitoring systems described herein.

The regulations in 2 CFR part 180 restrict making Federal awards, subawards, and contracts with certain parties that are debarred, suspended, or otherwise excluded from receiving or participating in Federal awards.

3. Prior to establishing any subrecipient agreement/contract each city agency/entity must screen their subrecipient candidates through SAM.gov’s Exclusion Listing to ensure each organization is eligible to work with both the city and federal government as well as the Maryland State Department of Assessments and Taxation (SDAT) to ensure the organization is in Good Standing with the state; moreover, annually all subrecipients must renew their SAM registration and each agency/entity must re-verify their subrecipients’ eligibility to work with the city;

4. All agencies/entities must adhere to AM-413.21 Federal Grants Registration and Unique Entity Identifier when determining eligible subrecipients.

5.
Beyond SAM.gov, per 2 CFR §200.332(c), a pass-through entity must evaluate each subrecipient's fraud risk and risk of noncompliance with a subaward to determine the appropriate subrecipient monitoring described in paragraph (f) of this section. When evaluating a subrecipient's risk, a pass-through entity should consider the following:

Grant Manager/Grant Program Manager/Agency Designee

(1)
The subrecipient's prior experience with the same or similar subawards;
(2)
The results of previous audits. This includes considering whether or not the subrecipient receives a Single Audit in accordance with subpart F and the extent to which the same or similar subawards have been audited as a major program;
(3)
Whether the subrecipient has new personnel or new or substantially changed systems; and,
(4)
The extent and results of any Federal agency monitoring (for example, if the subrecipient also receives Federal awards directly from the Federal agency).
6.
Once a subrecipient is deemed risk-free and eligible per the federal System for Award Management, accessed on SAM.gov, the agency/entity negotiates a subaward agreement that details the subrecipient’s minimum requirements as a pass-through entity, as well as their operational and fiscal requirements, the subrecipient’s name, UEI, Federal Award Identification Number (FAIN), Assistance Listing Number (ALN), etc. For a complete list of all requirements, reference: §200.332(b) Requirements for Pass-through Entities.
7.
After the agency/entity completes a grant agreement and the Law Department reviews it for legal sufficiency, the agency/entity submits the agreement to the Small and Minority Business Advocacy and Development Office (SMBAD) for review of potential goal setting or waiver eligibility. The agency/entity then contacts the SMBAD Office and follows their guidance for submitting the agreement and supporting documentation through the office’s SmartSheet application system.
8.
The agency/entity submits the grant agreement, supporting documentation, and SMBAD documentation to the Chief Administrator’s Office for review and once approved by the Administration, to the Board of Estimates’ BOE Submit portal for review and final approval by the Board. A grant award is not approved for any spending nor action until it receives approval by the Board of Estimates.

Grant Manager/Grant Program Manager

9.
Upon approval from the Board of Estimates, the agency/entity is responsible for setting up the grant as approved in the City’s financial system of record. Refer to the Grants Management Office for standard operating procedures.

Monitors the activities of the subrecipient as necessary to ensure that the subaward is used for authorized purposes, in compliance with Federal statutes, regulations, and terms and conditions of the subaward; and that subaward performance goals are achieved.§200.332 (c) details the agency/entity’s basic monitoring requirements.

10. Conducts an initial risk assessment to determine subrecipient risk of noncompliance and to inform a monitoring plan tailored to each subrecipient. Monitoring plans must include regular check-ins with the subrecipient at a cadence determined by the Grant Manager and subrecipient and should include at least one in-person site visit per performance period, unless otherwise specified by the terms of the agreement. Regular check-ins are intended to review performance progress, address issues, and review financials. Subrecipients deemed “low risk” may receive a monitoring plan of a minimum of quarterly check-ins, while subrecipients deemed “high risk” may receive a monitoring plan that includes monthly or weekly check-ins as well as more frequent in-person site visits. Monitoring plans are developed at the discretion of the Grant Manager and subrecipient utilizing the required risk assessment. More than one risk assessment may be conducted on a subrecipient during the performance period of the subaward, and monitoring plans may be adjusted accordingly.
