§ 41-4 Scope of Division – In general.LinkCopy Citation
(1)
Except as provided in <cite data-path="|7|§41-5">§ 41-5 of this subtitle</cite>, this Division IV applies to:
(i)
any person making application for a grading or building permit on a parcel or parcels of land for a total area of 5,000 square feet or greater;
(ii)
any person making application for a subdivision or development plan on a parcel or parcels of land for a total area of greater than 5,000 square feet; and
(iii)
a public utility not exempt under <cite data-path="|7|§41-5|(b)|(3)">§ 41-5(b)(3) of this subtitle</cite>.
(2)
All subdivision or development plan approvals subject to this Division IV shall be conditioned on approval of a concept Forest Conservation Plan. All grading or building permits subject to this Division IV shall be issued conditioned on approval of and compliance with a Forest Conservation Plan.
