For purposes of this Chapter, the following terms have the meaning indicated: (a) I-495 project means the widening of Interstate Route 495 between Bradley Boulevard and the American Legion Memorial Bridge. (b) District means a tax district created under Section 68B-3.

(a) The State Highway Administration has widened Interstate Route 495 between Bradley Boulevard and the American Legion Memorial Bridge in Montgomery County from 6 lanes to 8 lanes. (b) The I-495 project does not include adequate noise abatement measures to protect the properties in the districts from the harmful effects of the projected increase in road noise. (c) The I-495 project will substantially increase the noise level for the residents of the dwelling units in the districts. This increased noise may be harmful to the health of the residents of these units. (d) Noise abatement projects such as the construction of noise barriers will substantially reduce the noise from the I-495 project and thereby protect the health and general welfare of the residents of the districts. The barriers will also promote public safety for residents of the districts. (e) Creation of the districts is necessary to fund construction of a noise abatement project.

(a) Cabin John Noise Abatement Tax Districts. (a) The County Council must levy against the assessable real property in each district a tax rate sufficient to create the revenue necessary to pay the costs paid or reasonably expected to be paid in the next fiscal year by the County to construct the noise abatement project in each district. Costs include any principal and interest payments that are associated with any bond or other debt instrument issued by the County to finance the construction of a noise abatement project. (b) The tax is levied and collected as other County real property taxes are levied and collected by law. (c) The tax has the same priority, bears the same interest and penalties, and in every respect must be treated the same as other County real property taxes. (d) The tax rate may vary from one district to the other. (e) The County must record in the land records for each property within the districts that the property is subject to the requirements of this Chapter.
