(a)
All solicitations, including invitations for bids and requests for proposals, issued for construction projects by the County that have an estimated dollar value of Thirty-Five Million Dollars ($35,000,000) or more shall include a clause that requires the execution and use of a Project Labor Agreement, as defined herein:
(1)
Within sixty (60) days after enactment the County Executive shall provide a list of eligible projects and shall publish a list of eligible projects annually as part of the capital improvement plan.
(2)
The Project Labor Agreement Coordinating Committee may recommend Project Labor Agreements on county-wide, multi-location Capital Improvement Projects that will create workforce development opportunities to the County Executive.
(b)
A Project Labor Agreement shall:
(1)
Establish the terms and conditions of employment for all construction craft workers on the specified project;
(2)
Apply to and cover all contractors and subcontractors, at whatever tier, used to build the project and all labor organizations representing construction craft workers employed on the project; and
(3)
Contain the following minimum terms and conditions, as well as other terms that may be negotiated and agreed upon by the County, the applicable project contractors and labor organizations, that:
(A)
bind all contractors and subcontractors on the construction project through the inclusion of appropriate specifications in all relevant solicitation provisions and contract documents;
(B)
allow all contractors and subcontractors to bid and otherwise compete for contracts and subcontracts without regard to whether they are parties to collective bargaining agreements or otherwise affiliated with labor organizations;
(C)
contain contractual guarantees against strikes, lockouts, and similar job disruptions;
(D)
set forth effective, prompt, and mutually binding procedures for resolving labor disputes arising during the Project Labor Agreement;
(E)
provide that applicable project contractors and labor organizations shall work together and use reasonable best efforts to ensure that a goal of fifty-five percent (55%) of Prince George's County residents are afforded maximum opportunities for employment and skill training on Project Labor Agreement projects;
(F)
provide other mechanisms for labor-management cooperation on matters of mutual interest and concern, including productivity, quality of work, safety, and health.
(c)
Exemptions. Exemptions to a Project Labor Agreement may be granted if the Purchasing Agent and the Project Labor Agreement Coordinating Committee jointly determine that:
(1)
The construction project is of short duration and lacks operational complexity.
(2)
The construction project will involve only one craft or trade.
(3)
The construction project will involve specialized construction work that is available from only a limited number of contractors or subcontractors.
(4)
The agency's need for the construction project is of such an unusual and compelling urgency that a project labor agreement would be impracticable.
