Sec. 16-231. Pension plans for public safety employees

The County Executive shall be authorized to establish, by agreement, police and fire pension plans applicable to all uniformed employees occupying classified service positions allocated to public safety classes of work within the Police and Fire Departments. Any such pension plan, upon establishment, may not be amended to lessen the benefits provided therein or to bind the County to finance or make contributions thereto, unless such amendments are approved by legislative act of the County Council.

Subject to the provisions of Division II, State Personnel and Pensions Article, Annotated Code of Maryland, the County Executive is hereby additionally authorized to establish a pension plan for all uniformed employees occupying classified service positions allocated to public safety classes of work within the Sheriff Department, which, upon establishment, shall be similar in the nature of coverage and benefits to police and fire pension plans and shall be subject to the other conditions stipulated in Subsection (a) of this Section.

The County Executive shall be authorized to establish or amend a pension plan for employees occupying public safety classes of work within the Department of Corrections, subject to approval by legislative act of the County Council.
