Sec. 2-253.63. Fees and ChargesLinkCopy Citation
(a)
This fee schedule applies to fees and charges assessed by Prince George's County, Maryland for regulated activities that occur within its jurisdiction.
(b)
The fees prescribed in this schedule will supersede previous fees and charges assessed by Prince George's County, Maryland for regulated activities that occur within its jurisdiction.
(c)
All fees and charges are subject to a 5% technology fee with the exception of the multi-family rental license fee and the single-family rental license fee.
(d)
Subject to Subsection (j), below, the Director of the Department of Permitting, Inspections and Enforcement shall establish and maintain a comprehensive Table of Fees, as referenced and included in this Bill, for all types of permits. The Director or the County Council shall have the authority to change the fees from time to time as is determined necessary; and the Director shall republish the Table of Fees which shall be posted in the Department of Permitting, Inspections and Enforcement's Permit Office and on its website. Prior to implementing a change in the fees, the Director of the Department of Permitting, Inspections and Enforcement shall hold public informational sessions to allow for public comment as part of this process. The Director shall also submit the proposed Table of Fees to the County Executive for approval and for transmittal to the County Council for legislative review and approval by resolution, after notice and public hearing.
(e)
The Director of the Department of Permitting, Inspections and Enforcement shall promulgate written regulations to establish and govern a method of notification for increases as a result of the International Code Council and industry standard increases. The Director shall also promulgate written regulations for the administration of the provisions of this Section and shall, at his or her discretion, hold public informational sessions to allow for public comment as part of this process.
(f)
Fees may be adjusted using a method established by the International Code Council and industry standards pursuant to paragraphs (d) and (e) of this Section. Any changes to fees and charges that are not connected to the International Code Council or industry standards, except for those prescribed in Subsection (j), below, shall be changed by County Council approval by resolution, after notice and public hearing.
(g)
Each fee set forth in the schedule shall be paid in advance of the issuance of a permit, license, plan or item as set forth in the schedule. If the application review is pending through no fault of the licensee after the expiration date, then that application will not be subject to administrative late fees. Fees shall not be refunded in whole or in part once work has begun, licenses or permits have been issued or funds have been encumbered. Prior to those itemized occurrences and within six (6) months of payment, it is within the discretion of the Director of the Department of Permitting, Inspections and Enforcement to issue a refund.
(h)
The fees and charges shall be designated in a Table of Fees section 2-253.63, Attachment A and as published on the DPIE website.
(i)
Fees and charges pursuant to this section assessed to a Locally owned and Operated Business as defined in Section 10-335(a)(4) shall be discounted by 50% at the time of such assessment.
(j)
Special Quality of Life Impact Uses.
(1)
The following fees shall apply and be remitted in advance of the issuance of Use and Occupancy permits for the following uses:
(A)
Any business that is a commercial use with a Class A beer, wine, and liquor license pursuant to Title 26, Subtitle 9 of the Alcoholic Beverages and Cannabis Article, Annotated Code of Maryland - $5000;
(B)
Any business that is a tobacco shop, electronic cigarette shop, retail tobacco business, or convenience store use, as prescribed under Part 27-5 of Subtitle 27 of the Code, with a tobacco retail license issued by the Maryland Alcohol, Tobacco, and Cannabis Commission - $5000;
(C)
Any business that is a commercial use operating pursuant to a State of Maryland Regulated Firearms Dealer's License under Title 5, Subtitle 1 of the Public Safety Article, Annotated Code of Maryland - $5000; and
(D)
Any business that is a consolidated storage use, as prescribed under Part 27-5 of Subtitle 27 of the Code - $5000
(2)
Renewal fee. Each business to which Paragraph (1), above, is applicable shall be required to remit an annual Use and Occupancy permit renewal fee in the amount of $5000 per year due every 12 months after the date of initial use and occupancy permit approval. Any business defined under (A), (B), (C), or (D) in Paragraph (1), above, with an existing Use and Occupancy permit as of the effective date of this Subsection shall commence remitting an annual Use and Occupancy permit renewal fee due no later than January 1, 2027 of $5000 and by every January 1st thereafter. The Use and Occupancy permit of any business that does not comply with this Paragraph shall be invalid and revoked by the Director of the Department of Permitting Inspections and Enforcement.
(3)
Revocation. The Use and Occupancy permit of any business that does not comply with this Paragraph shall be invalid and revoked by the Director of the Department of Permitting, Inspections, and Enforcement. Prior to the revocation of a permit under this paragraph, the Director shall give written notice to the permittee setting forth the basis of the revocation. Any person whose permit is revoked under this paragraph may appeal the decision of the Director to the Board of Administrative Appeals for Prince George's County within ten (10) calendar days after receipt of notice of revocation.
(4)
As a courtesy, the Director of the Department of Permitting Inspections and Enforcement may notify in writing any business that is subject to a Use and Occupancy permit renewal fee requirement pursuant to this Subsection of its renewal fee obligation at least 90 days before the renewal fee due date and may grant up to a 90-day grace period for late renewal fee payments. Failure to provide this discretionary renewal notice is not a legal basis to challenge the revocation of the Use and Occupancy permit or any other enforcement action taken pursuant to this Subtitle.
(5)
On February 1st of each year, the Director of the Department of Permitting, Inspections, and Enforcement shall increase the fees prescribed in this Subsection by the greater of (i) the average Consumer Price Index for All Urban Consumers (CPI-U) for the Washington-Arlington-Alexandria area published by the Federal Bureau of Labor Statistics for the previous calendar year or (ii) zero percent.
(6)
Quality of Life Improvement Fund. The Office of Finance shall establish and administer a Quality of Life Improvement Fund, a nonlapsing fund into which all fees remitted in accordance with this Subsection shall be deposited and that shall not revert to the County fund balance at the end of each fiscal year. Funds from the Quality of Life Improvement Fund shall be used solely for the following:
(A)
Quality of life improvements for the residents of Prince George's County, which may include, but are not limited to including:
(i)
Youth, child care, and educational programs, projects, and initiatives;
(ii)
Public health and senior wellness programs, projects, and initiatives;
(iii)
Public safety, pedestrian safety, and road and transit safety programs, projects, and initiatives; and
(iv)
Economic assistance programs, projects, and initiatives for residents and businesses in socioeconomically disadvantaged circumstances; and
(v)
Administrative costs associated with operating quality of life improvement programs identified in this subparagraph.
(B)
At the time of remittance, 10% of the fees remitted to the Quality of Life Improvement Fund shall be disbursed to the Prince George's County Early Start Child Care Scholarship Fund and 5% of the fees remitted to the Quality of Life Improvement Fund shall be disbursed to the Child Care Facilities Loan Program.
(C)
Except for disbursements mandated by Subparagraph (B), above, any disbursements from the Quality of Life Improvement Fund shall be proposed and approved by County Council resolution.
(7)
This Subsection shall not apply to any use that is operating as a gas station.
(k)
Sit-down Restaurant Permitting Incentive Program.
(1)
Definition. For the purposes of this subsection, Sit-down restaurant means a restaurant, as defined pursuant to Part 27-2 of Subtitle 27 of the Code, whose principal method of operation consists of sit-down table service provided by dedicated waitstaff for on-site food and beverage consumption. A sit-down restaurant must provide table service to at least ninety percent (90%) of its patrons, and one hundred percent (100%) of its patrons must be served by dedicated waitstaff. Restaurants whose principal method of operation is counter service, quick service, or carryout food and beverage service for offsite consumption are not sit-down restaurants under this Subsection. Restaurants that provide drive through service are not sit-down restaurants under this Subsection.
(2)
Sit-down Restaurant Permitting Incentive. Fees and charges pursuant to this section assessed to a business that is a sit-down restaurant or to an applicant to operate as a sit-down restaurant shall be discounted by fifty percent (50%) at the time of such assessment.
(3)
The Director of the Department of Permitting, Inspections, and Enforcement:
(A)
shall interpret this Section and assess the features of a business applicant to determine whether the business is a sit-down restaurant in accordance with this Subsection before applying the discount prescribed herein; and
(B)
is authorized to promulgate regulations to administer this Act, subject to approval by resolution of the County Council.
