## Title 12. Baltimore City

### Subtitle 24. Judicial Review

#### Section 12-2401

(a) The following sections of Title 4, Subtitle 9 ("Judicial Review") of Division I of this article apply in the City without exception or variation:

  (1) Sec. 4-902 ("Judicial review of decision of local licensing board");

  (2) Sec. 4-903 ("Petitioners");

  (3) Sec. 4-905 ("Scope of judicial review");

  (4) Sec. 4-906 ("Representation of local licensing board");

  (5) Sec. 4-907 ("Affirmations, modifications, and reversals"); and

  (6) Sec. 4-908 ("Appeals to Appellate Court of Maryland and Supreme Court of Maryland").

(b) Section 4-904 ("Stay of local board's petition") applies in the City, subject to Sec. 12-2402 of this subtitle.

#### Section 12-2402

An order by the Board to revoke a license may be stayed, pending judicial review, only by the court with which a petition under Title 4, Subtitle 9 of this article has been filed.

#### Section 12-2403

In addition to the other powers of the circuit court for the City provided in Title 4, Subtitle 9 of this article, the court may remand the proceedings to the Board.
