There is a Board of License Commissioners for Cecil County.
The County Commissioners shall appoint three members to the Board.
Each member of the Board shall be of high moral character and possess a sound reputation for integrity.
The term of a member is 3 years.
The terms of the members are staggered as required by the terms provided for members of the Board on July 1, 2016.
At the end of a term, a member continues to serve until a successor is appointed and qualifies.
A member who is appointed after a term has begun serves only for the rest of the term and until a successor is appointed and qualifies.
The County Commissioners may remove a member for misconduct in office, incompetence, or willful neglect of duty.
From among its members, the Board shall designate a chair.
The Board shall meet at least once a month.
The chair of the Board shall receive an annual salary of $3,000.
Each other member of the Board shall receive an annual salary of $2,500.
The chair and each other member of the Board shall be reimbursed for expenses in accordance with the Standard State Travel Regulations.
The expenses shall be paid by the county.
Subject to § 17–205 of this subtitle, the Board may:
employ:
a secretary;
inspectors; and
clerical and other assistants as are necessary; and
set the compensation of the employees.
The Board may employ one full–time inspector and as many part–time inspectors as the Board considers necessary.
The employment of the inspectors is subject to the County Personnel Policy and Procedure Manual.
An individual may not accept appointment or continue as an inspector if the individual or a member of the individual’s immediate family has a personal or financial interest directly or indirectly in a license or in a premises licensed under this article.
An inspector:
has all the powers of a peace officer or sheriff in the State arising out of or relating to the enforcement of this article; and
may serve a summons under § 17–2603 of this title.
An inspector shall:
investigate all applicants for a license or transfer of a license;
visit and inspect at unannounced times every licensed premises in the county at least once every 90 days;
enforce all alcoholic beverages laws;
investigate all violations of the alcoholic beverages laws and report them to the Board; and
submit monthly reports in writing to the Board of the inspector’s activities, setting forth complaints and listing violations that the inspector observed or were reported to the inspector.
An inspector shall take the oath required by Article I, § 9 of the Maryland Constitution.
The salaries and travel expenses of the inspectors shall be established by the County Commissioners using county personnel department regulations and guidelines.
The Board may adopt regulations to carry out this article.
