### Subtitle 28. Penalties

#### Section 26-2801

Section 6-402 ("General penalty") of Division I of this article applies in the county, subject to Sec. 26-2801.1 of this subtitle.

#### Section 26-2801.1

In addition to any administrative penalty that may apply, a license holder or an employee of a license holder who violates Sec. 6-304 of this article or Sec. 10-117 of the Criminal Law Article is guilty of a misdemeanor and on conviction is subject to imprisonment not exceeding 2 years or a fine not exceeding $2,000 or both.

#### Section 26-2802

(a) This section applies to a violation that is cause for suspension or revocation of a license.

(b) Instead of or in addition to suspending or revoking the license, the Board may:

  (1) for a first offense:

    (i) except as provided in item (ii) of this item, impose a fine not exceeding $1,500; or

    (ii) for a violation of Sec. 10-117 of the Criminal Law Article, impose a fine of $1,500;

  (2) for a second offense in the same 24-month period, impose a fine not exceeding $6,000; and

  (3) for a third offense in the same 24-month period, impose a fine of $7,500.

(c) For a fourth offense in the same 24-month period, the Board shall suspend the license for 30 days, unless the Board revokes the license.

#### Section 26-2803

(a) The Board shall establish a standard fine structure for violations of this title that gives the Board flexibility to consider aggravating or mitigating factors when determining the amount of a fine imposed under this title.

(b) The Board shall publish monthly and maintain on its website:

  (1) a list of penalties for violations of this title; and

  (2) the standard fine structure established under subsection (a) of this section, including a list of aggravating and mitigating factors that the Board may consider when determining the amount of a fine imposed under this title.
