Notwithstanding any other provision of law, the Health Department shall have access to information maintained by the Judiciary about a criminal defendant who is: subject to examination under the provisions of this title; committed to the Health Department under the provisions of this title; or on conditional release under the provisions of this title. Before exchanging any information in accordance with this section, the Health Department and the Judiciary shall enter into an agreement regarding: the individuals who may have access to information under this section; what information is accessible to the individuals in item (1) of this subsection; and the ways in which the information accessed may be used.
