## Title 5. Economic Development and Financial Assistance Programs

### Subtitle 4. Maryland Industrial Development Financing Authority

#### Section 5-444

(a)

  (1) The Authority shall participate in financial assistance programs for energy projects provided by the federal Energy Security Act, P.L. 96-294.

  (2) For purposes of that Act, the Authority is a "person" as defined in:

    (i) 42 U.S.C. Sec. 8802, concerning the financing of biomass energy, municipal solid waste, and alcohol fuels projects; and

    (ii) 30 U.S.C. Sec. 1511, concerning the financing of geothermal energy projects.

(b) For purposes of the federal Public Utility Regulatory Policies Act of 1978, the Authority is a "nonprofit organization" as defined in 16 U.S.C. Sec. 2708 and used in 16 U.S.C. Sec.Sec. 2702 and 2703, concerning small-scale hydropower projects.
