There is a Governor’s Artificial Intelligence Subcabinet of the Governor’s Executive Council. The purpose of the Subcabinet is to facilitate and enhance cooperation among units of State government, in consultation with academic institutions and industries utilizing artificial intelligence. The Subcabinet consists of the following members: the Secretary, or the Secretary’s designee; the Secretary of Budget and Management, or the Secretary’s designee; the Secretary of General Services, or the Secretary’s designee; the Secretary of Labor, or the Secretary’s designee; the Secretary of Commerce, or the Secretary’s designee; the Director of the Governor’s Office of Homeland Security, or the Director’s designee; the Chief Privacy Officer, or the Chief Privacy Officer’s designee; the Chief Data Officer, or the Chief Data Officer’s designee; the Chief Information Security Officer, or the Chief Information Security Officer’s designee; the Governor’s Senior Advisor for Responsible Artificial Intelligence, or the Senior Advisor’s designee; and any other member of the Governor’s Executive Council, appointed by the Governor. The Secretary shall chair the Subcabinet. The Subcabinet shall: develop strategy, policy, and monitoring processes for responsible and productive use of artificial intelligence and associated data by units of State government; oversee the State’s implementation of: artificial intelligence inventory; artificial intelligence impact assessments; monitoring of high–risk artificial intelligence; and compliance with State policies and procedures; support artificial intelligence and data innovation across units of State government; develop and implement a comprehensive action plan for responsible and productive use of artificial intelligence and associated data by units of State government; establish partnerships, memoranda of understanding, and contracts to support the aims of this section; promote artificial intelligence knowledge, skills, and talent in State government; and identify artificial intelligence use cases and build foundational infrastructure by requiring: the Department to evaluate relevant infrastructure to safely, securely, and efficiently test artificial intelligence proofs of concept and pilots; the Department of General Services, in consultation with the Department, to create a model for running and procuring artificial intelligence proofs of concept and pilots, in accordance with State laws, regulations, and policies; and the Department, in consultation with the Subcabinet, to coordinate with agencies to provide support in identifying and prioritizing use cases and executing proofs of concept and pilots aligned with the Governor’s priorities. The Subcabinet may request research to be completed under § 14–111 of the Education Article. The Governor shall provide the Subcabinet with sufficient resources to perform the functions of this section.
