A.
The Department shall adopt a formula and qualifications for allocating Program funds to jurisdictions based on funding availability and jurisdiction-wide statistics for the:
(1)
Number of individuals and families living in poverty;
(2)
Unemployment rate;
(3)
Number of individuals and families receiving food stamps; and
(4)
As available, number of individuals and families requesting food assistance.
B.
The Department shall ensure that not more than 5 percent of the funds are used for administrative costs by either the Department, the administering agency, or both of them.
