Regulation .07 Stay Pending Disposition of CINA Proceeding.Copy Citation

A.
An appellant and the local department shall notify OAH of any CINA proceeding of which they are aware concerning a child:
(1)
Who has been allegedly abused or neglected by the appellant; or
(2)
Who is in the care, custody, or household of the appellant.
B.
If a CINA proceeding is pending, OAH shall stay the hearing until the child is found by a court to be a CINA or the CINA proceeding is otherwise concluded.
C.
After a CINA proceeding has concluded, OAH shall vacate the stay and schedule further proceedings in accordance with this chapter.
