The local department shall deny the application for refusal to cooperate if the applicant or recipient refuses to cooperate with the local department in completing the process described in Regulation .03 and .04 of this chapter. To make a determination of refusal to cooperate, the local department shall determine that the individual was able to cooperate but demonstrated that the individual would not take the actions that were required to complete the application process. If there is a question as to whether the individual has only failed to cooperate, as opposed to refused to cooperate, the local department may not deny the individual on the grounds of refusal to cooperate. The local department shall find the individual ineligible if the individual refuses to cooperate in subsequent reviews of eligibility, including reviews generated by reported changes and applications for redetermination.
