A.
All individuals included in the RCA unit shall meet the requirements as described in Regulation .03 of this chapter.
B.
The LDSS:
(1)
Shall include childless refugee married couples in the same assistance unit, unless one member receives SSI; and
(2)
May not include in the same assistance unit adult refugees related to one another such as brothers and sisters.
C.
The assistance unit may not include:
(1)
An individual who fails to meet technical factors of eligibility as described in Regulation .03 of this chapter;
(2)
An individual who is fleeing to avoid prosecution or custody or confinement after conviction for a crime or an attempt to commit a crime, which is:
(a)
A felony under the laws of the place within the United States from which the individual is fleeing; or
(b)
In the case of New Jersey, a high misdemeanor under the laws of that state;
(3)
An individual violating a condition of probation or parole imposed under federal or state law;
(4)
An individual convicted of IPV as described in Regulation .17B of this chapter;
(5)
An institutionalized individual; or
(6)
An SSI recipient.
