An applicant for a license under the chapters listed in Regulation .01, of this chapter, may request a variance to specific licensing regulations. An application for a variance shall: Be written; Contain specific details of the alternative procedures proposed by the applicant; and Demonstrate that the alternative procedures proposed shall: Meet or produce the intended effects of each regulation for which the variance is requested and Maintain the health, safety, and well-being of children in the facility at or above the level required by each regulation for which the variance is requested.
