## Subtitle 39 — Board of Nursing — Certificate Holders

### Chapter 04 — Medication Technicians

#### Regulation .01 Exclusions.

*COMAR 10.39.04.01*

This chapter does not apply to an individual who is:

A. Practicing a health occupation, other than as medication technician, that the individual is authorized to perform under Health Occupations Article, Annotated Code of Maryland;

B. A student enrolled in an approved nursing education program while practicing registered nursing or licensed practical nursing in that program;

C. Providing gratuitous care of friends or family members;

D. Performing medication technician tasks while a student practicing under the direct supervision of qualified faculty in a Board-approved medication technician training program; or

E. Working as a school principal or school secretary, does not administer medication as a routine part of the position, and, after completing training by the school's delegating nurse, administers medication due to the absence of the nurse or medication technician.
