Regulation .05 Surplus Funds.

If the amount of assessed funds collected in a calendar year exceeds the cap identified in Health-General Article, §21–2C–11(B)(4), the Board shall:

Issue a notice of such surplus; and

Remit the surplus funds in a fair and equitable manner across all qualifying entities that have paid the assessment.
