A.
Applicability. The Authority may award a procurement contract to a sole source without competition:
(1)
When a requirement is available from only a single source or vendor; or
(2)
To retain confidential services:
(a)
To advise the Authority in connection with threatened or pending litigation; or
(b)
For the appraisal of real property contemplated for acquisition by the Authority.
B.
Determination. A determination to make a procurement by sole source without competition shall be made by the Executive Director based on a finding that a sole source procurement is in the Authority’s best interest.
