Chapter 15. Negotiability Disputes

If a negotiability dispute arises between the employer and the exclusive representative, either party may petition the Board for expedited resolution of the dispute.

The petition shall set forth the material facts of the dispute and the precise question of negotiability submitted for resolution and include certificate of service upon the other party.

The petition filed pursuant to Regulation .01 of this chapter shall be given priority by the Board.

As deemed appropriate by the Board, the petition may be set for informal resolution, hearing, or oral argument, or decided upon submission of briefs.
