This chapter is adopted in response to the U.S. Supreme Court’s decision in North Carolina Board of Dental Examiners v. Federal Trade Commission. The purpose of this chapter is to provide for active supervision of certain units within the Department to: Prevent unreasonable anticompetitive actions; and Ensure that anticompetitive actions are consistent with affirmatively expressed and clearly articulated State policies to displace competition.
