The Department may deny an application for renewal, or revoke or suspend the current registration of any device: For operating without a current registration for the device; For any violation of this chapter, including providing false information to the Department or any violation of any certification by the organization to the Department under Regulation .03 of this chapter; or If the Department determines that the biodiesel blend fuel is commercially available in the market area where the device is located. Before the Department takes any action under this regulation, the organization shall be given reasonable notice and the opportunity to be heard.
