The Department or a designee may examine records, and may inspect and sample without charge any compost or compost product of any producer or distributor to determine if the records or compost complies with the requirements of this chapter. A sample or lot found by the Department not to be in conformity with the regulations in this chapter or with the Maryland Commercial Fertilizer Law shall be subject to a penalty or a stop-sale order. The Department shall issue a written notice of the violation. The Department may inspect any load of compostable material or compost for hazardous or noncompostable material.
