In General. If a hearing request lacks necessary information or is otherwise improper, the Secretary may: Deny the request; Return the request for resubmission in proper form and with all necessary information; or Conditionally accept the request subject to submission, within the time the Secretary specifies, of supplemental information. Effect of Denial, Return, or Conditional Acceptance. The denial, return, or conditional acceptance of a request does not extend the time under Regulation .02A of this chapter within which a request is required to be filed.
