A.
In General. A party may move for summary decision on any appropriate issue in the case.
B.
Decision. The Secretary may grant a final summary decision if the Secretary finds that:
(1)
There is no genuine issue as to any material fact; and
(2)
The moving party is entitled to prevail as a matter of law.
