Except as set forth in State Finance and Procurement Article, §12-104(b), Annotated Code of Maryland, the Board may modify or waive the requirements of this title as to a procurement contract or a class of contracts that are to be performed entirely outside the United States to the extent: The basic purposes of State Finance and Procurement Article, §11-201, Annotated Code of Maryland, are maintained; The circumstances of the procurement require the modification or waiver; and Foreign contractors are expected to be involved in the procurement.
