Whenever the provisions of this chapter cannot be satisfied, the procurement officer shall: Make a determination, subject to the approval of the agency head, that explains or justifies the need to make a procurement which does not satisfy the requirements of this chapter; and Retain that determination in the contract file for at least 3 years.
