A.
New wastewater discharges to intermittent streams are not permitted after the effective date of this regulation except to resolve existing on-site sewage disposal failures when other alternatives are not available.
B.
Effluent limitations for discharge to intermittent streams may not be less stringent than:
(1)
The minimum national effluent guidelines established under the Federal Act;
(2)
Those levels necessary to maintain the water quality standards of the intermittent stream and of downstream segments;
(3)
Those levels necessary to protect the biological community of the intermittent stream; or
(4)
Those levels necessary to protect public health.
