Regulation .01 Scope.

This chapter applies to an owner, an operator, and a person in charge of an oil-contaminated soil (OCS) facility.

This chapter is not intended to and does not relieve an owner, an operator, and a person in charge of an OCS facility of the duty to comply with all other applicable requirements of COMAR 26.10.

This chapter does not affect the Department’s authority to direct a corrective action conducted in response to an oil spill, release, or discharge in accordance with the requirements of COMAR 26.10.01 and 26.10.08—26.10.10.
