(a) Construction of residual oil fired units of less than 13 million Btu (13.7 gigajoules) per hour prohibited (see Regulation .04).

(b) Built before July 1, 1975.

(c) Construction of new solid fuel fired units of less than 35 million Btu (37 gigajoules) per hour prohibited (see Regulation .04B).

See Figures 1 & 2.

Notes:

1. The construction of new residual oil fuel-burning equipment under 13 MM Btu (13.7 gigajoules) per hour is prohibited under Regulation .04.

2. The construction of new solid fuel-burning equipment under 13 MM Btu (13.7 gigajoules) per hour is prohibited unless an exception has been approved by the Department (see Regulation .04).

3. New fuel-burning equipment over 250 MM Btu (263.8 gigajoules) per hour are regulated by NSPS source regulations COMAR 26.11.06.12.

4. Depending on load factor, fuel ash content, and control equipment, fuel-burning equipment which has a heat input greater than approximately 25 MM Btu (26.4 gigajoules) per hour may be subject to Prevention of Significant Deterioration Review (40 U.S.C. Part §52.21) and consequent additional control requirement.
