A.
Except as provided in §B of this regulation, an owner or operator of a facility in which thermal treatment and open burning is conducted shall comply with 40 CFR §§265.370—265.382, which is incorporated by reference in COMAR 26.13.01.05B(1)(b).
B.
For the purposes of this regulation:
(1)
Owners and operators of thermal treatment devices subject to this regulation may not burn EPA Hazardous Wastes F020, F021, F022, F023, F026, or F027; and
(2)
In 40 CFR §265.370, delete the clause “and Subpart H of part 266, if the unit is a boiler or industrial furnace as defined in §260.10”.
