Except as provided in §B of this regulation, an owner or operator of a facility in which thermal treatment and open burning is conducted shall comply with 40 CFR §§265.370—265.382, which is incorporated by reference in COMAR 26.13.01.05B(1)(b). For the purposes of this regulation: Owners and operators of thermal treatment devices subject to this regulation may not burn EPA Hazardous Wastes F020, F021, F022, F023, F026, or F027; and In 40 CFR §265.370, delete the clause “and Subpart H of part 266, if the unit is a boiler or industrial furnace as defined in §260.10”.
