License and permit fees shall be as prescribed in the Act. Application fees are not refundable. The Department shall return the special reclamation fee and recording fee for the right-of-entry agreement to the applicant if a permit is denied. The Department shall deposit all fees except right-of-entry recording fees in the Surface Mined Land Reclamation Fund.
