## Subtitle 24 — Tidal Wetlands

### Chapter 01 — General

#### Regulation .07 Waivers.

*COMAR 26.24.01.07*

A. If the Department determines, from the information submitted with an application for a private wetlands permit, that a waiver of a regulation of this subtitle is in the public interest, the Department may grant relief from the requirement upon request.

B. If a waiver results in the loss of tidal wetlands, the applicant is required to mitigate for that loss in accordance with COMAR 26.24.05.01.
