A subsidy award may be renewed annually if:
A.
Sufficient State funds for subsidies are available in the Department's budget;
B.
The provider's budget for the next fiscal year has been approved by the Department;
C.
The Department and the provider have executed a subsidy services agreement for the next fiscal year; and
D.
The provider and facility are in compliance with this chapter.
